1. Introduction and Acceptance

These Terms of Service ("Terms") govern your access to and use of the Forgeable platform and services ("Service") provided by Forgeable ApS ("Forgeable", "we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Definitions

• "Service" — the Forgeable platform, including the website, API, and all related tools and features.
• "User" — any individual or entity that accesses or uses the Service.
• "Content" — any data, text, files, images, prompts, or other materials uploaded, submitted, or generated through the Service.
• "Task" — a prompt configuration created by a User within the Service.
• "Variant" — different versions or configurations of a Task.
• "Execution" — running a Task through the Service to generate AI output.

3. Eligibility and User Representations

By accessing or using the Service, you represent and warrant that:

• You are at least 18 years old
• You have the legal capacity and authority to enter into these Terms
• If using the Service on behalf of an organization, you have authority to bind that organization
• You are not located in any country subject to comprehensive trade sanctions
• You are not on any restricted party list maintained by governmental authorities

4. Account Terms

To use certain features of the Service, you must create an account. When creating an account, you agree to:

• Provide accurate and complete registration information
• Maintain the security and confidentiality of your account credentials
• Promptly notify us of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

5. Service Description

Forgeable is an AI-powered prompt optimization platform that enables users to create, test, and refine AI prompts. The Service includes:

• Task creation and management with structured input/output schemas
• Multiple variant support for testing different prompt configurations
• Integration with third-party AI providers for prompt execution
• File upload and processing capabilities
• Execution tracking and analytics
• API access for programmatic integration

6. User Content and Data

Ownership

You retain all ownership rights to the Content you submit to the Service, including your prompts, configurations, and uploaded files.

License Grant

By submitting Content, you grant Forgeable a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, process, store, reproduce, modify, and transmit your Content for:

• Providing, operating, and maintaining the Service
• Improving and enhancing the Service, including developing new features
• Training, improving, and developing AI models and algorithms
• Analyzing usage patterns and generating aggregated, anonymized insights
• Ensuring the security and integrity of the Service

AI Training

Your Content, including prompts, inputs, outputs, and feedback, may be used to train, improve, and develop AI models and machine learning systems operated by Forgeable.

Third-Party Processing

Your Content may be sent to third-party AI service providers (such as OpenAI and Groq) for processing. Third-party providers may have their own data usage policies.

7. Acceptable Use

You agree not to use the Service for the following:

Illegal and Harmful Content

• Violate any applicable laws or regulations
• Generate or distribute child sexual abuse material (CSAM) or content exploiting minors
• Create content promoting violence, terrorism, or violent extremism
• Develop or acquire information about weapons or explosives
• Generate content promoting hatred, discrimination, or harassment

Deception and Fraud

• Engage in fraud, scams, phishing, or financial deception
• Impersonate individuals or organizations without disclosure
• Generate disinformation or fake reviews
• Represent AI-generated Output as human-generated without disclosure
• Conduct political campaigning or election interference

Security and Infrastructure

• Attempt unauthorized access to the Service or other accounts
• Interfere with or disrupt the Service infrastructure
• Circumvent security features
• Create or distribute malware or conduct cyberattacks
• Exceed applicable rate limits

Intellectual Property and Competition

• Infringe intellectual property rights of others
• Reverse engineer or derive source code from the Service
• Use the Service to develop competing AI products or train competing models
• Scrape or harvest data without permission
• Resell or sublicense access without authorization

High-Risk Applications

• Use the Service as sole basis for high-stakes decisions (employment, credit, insurance, housing, education, legal, healthcare) without human oversight
• Use for surveillance or facial recognition without proper consent

We reserve the right to suspend or terminate access for violations of these terms.

8. Intellectual Property

Your Input

You retain all ownership rights to Content you submit ("Input"). You represent and warrant that you have all necessary rights and permissions to submit your Input.

Output Ownership

Subject to your compliance with these Terms, Forgeable assigns to you all its right, title, and interest (if any) in output generated by the Service ("Output"). You are responsible for ensuring your use of Output complies with applicable laws.

Output Similarity

Due to the nature of AI, Output may not be unique. Other users may receive similar or identical Output. Our assignment of rights does not extend to other users' Output.

Forgeable Platform

The Service, including its design, features, code, algorithms, and documentation, is the property of Forgeable ApS and protected by intellectual property laws.

Feedback

If you provide feedback or suggestions ("Feedback"), you grant Forgeable an unlimited, irrevocable, perpetual, royalty-free license to use such Feedback without obligation to you.

Copyright Claims

If you believe your copyrighted work has been infringed, please send a notice to legal@forgeable.ai with:

1. Physical or electronic signature of the copyright owner
2. Identification of the copyrighted work
3. Identification and location of the infringing material
4. Your contact information
5. Statement of good faith belief that use is not authorized
6. Statement under penalty of perjury that the information is accurate

We may delete infringing content and terminate accounts of repeat infringers.

9. Third-Party Services

The Service integrates with third-party AI providers, including OpenAI and Groq. Your use of these integrations is subject to the third-party providers' terms.

We do not guarantee the availability, accuracy, or performance of third-party services and are not responsible for third-party service outages or changes.

10. Data Privacy

Please review our Privacy Policy for information about how we collect, use, and protect your data.

We process personal data in accordance with the General Data Protection Regulation (GDPR) and other applicable data protection laws.

11. Service Availability

We strive to provide reliable access to the Service, but do not guarantee uninterrupted availability. The Service may be subject to:

• Scheduled maintenance and updates
• Unplanned outages due to technical issues
• Modifications, suspensions, or discontinuation of features

We will make reasonable efforts to notify users of significant planned maintenance or changes.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SATISFACTORY QUALITY, NON-INFRINGEMENT, AND QUIET ENJOYMENT.

No Guarantee of Accuracy

We do not warrant that the Service will be uninterrupted, accurate, or error-free, or that Content will be secure or not lost.

AI Output Accuracy

AI-generated output may contain errors or inaccuracies. You are solely responsible for reviewing and verifying Output before relying on it.

Not Professional Advice

The Service does not constitute professional advice. Do not rely on it for medical, legal, financial, tax, or other professional guidance.

Confidential Information

Do not submit confidential or sensitive information unless you understand and accept the risks. Content may be processed by third-party AI providers.

Beta Features

Beta or experimental features are provided "as is" without warranties, may be unstable, and may be discontinued without notice.

13. Limitation of Liability

Exclusion of Damages

To the maximum extent permitted by law, Forgeable ApS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or business opportunities.

Liability Cap

Our total aggregate liability shall not exceed the greater of: (a) amounts you paid to Forgeable in the twelve (12) months prior to the claim, or (b) one hundred euros (€100).

Consumer Rights

Nothing in these Terms excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence or fraud.

14. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Forgeable ApS, its affiliates, officers, directors, employees, and agents from claims arising from:

• Your use of the Service in violation of these Terms
• Your Content or account activity
• Your violation of third party rights, including intellectual property
• Claims that your Content caused damage to a third party

15. Termination

By You

You may terminate your account at any time by contacting legal@forgeable.ai.

By Us

We may suspend or terminate your access at any time for violations or at our discretion, with or without notice.

Effect of Termination

Upon termination, your access will cease immediately. We may retain data as required by law or for legitimate business purposes.

16. Export Controls and Trade Compliance

You agree to comply with all applicable export control and trade sanction laws, including those of Denmark and the European Union.

You represent that your Content does not include material requiring government license or otherwise restricted under export control laws.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of Denmark, without regard to conflict of law provisions.

Disputes shall be subject to the exclusive jurisdiction of the courts of Denmark.

EU consumers may benefit from mandatory consumer protection laws of their residence and may bring proceedings in local courts.

18. Changes to Terms

We may modify these Terms at any time. For material changes, we will provide at least thirty (30) days' advance notice where practicable.

Continued use after changes constitutes acceptance. If you disagree with changes, you must stop using the Service.

19. General Provisions

Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement and supersede prior agreements.

Severability: Invalid provisions will be limited to the minimum extent necessary; remaining provisions remain in effect.

Waiver: Failure to enforce any right is not a waiver of that right.

Assignment: You may not assign these Terms without consent. We may assign without restriction.

No Third-Party Beneficiaries: These Terms do not create third-party beneficiary rights.

Survival: Provisions that should survive termination will survive (ownership, warranties, liability, indemnification, disputes).

Force Majeure: Neither party is liable for delays due to causes beyond reasonable control.

Electronic Communications: You consent to receive electronic communications satisfying legal writing requirements.
